What is Online Rental Agreement?
An Online Rental Agreement is a legal contract between two parties β the Owner (Licensor) and the Tenant (Licensee) β allowing the tenant to temporarily occupy and use an immovable property such as a Shop, Flat, or Commercial Office for a specific period. This agreement defines the terms and conditions under which the property is rented for residential or business purposes, ensuring a clear and lawful relationship between both parties.

Is it compulsory to register Online Rental Agreement?
Yes. As per the Registration Act, 1908, every rental or lease agreement must be in writing and registered when letting out or renting any premises.
A registered Online Rental Agreement serves as conclusive legal evidence of the terms and facts stated within it, ensuring protection and validity for both the owner (licensor) and the tenant (licensee).

Is a leave and license exempted from Rent Control Act?
Yes. The provisions relating to standard rent and permitted rent increases under the Rent Control Act do not apply to premises that are let out or given on a Leave and License basis.
This means that Leave and License agreements are exempted from the usual rent control restrictions, allowing the owner and tenant to mutually decide the rent and terms of occupation.

What are the rights of licensor and licensee?
A Licensee has only the right to occupy and use the property as a temporary user (licensee). The licensee cannot transfer this right to another person and does not have exclusive possession of the property. The legal possession of the property remains with the Licensor (Owner) at all times. The Licensor, therefore, retains ownership and control, while merely granting the Licensee permission to use the premises under the agreed terms.
